Acceptance of Terms
By accessing or using WarePulse, you agree to be bound by these Terms of Service. WarePulse is operated by Next Movement. If you do not agree to these terms, please do not use our service.
Description of Service
WarePulse is a cloud-based warehouse management system (WMS) that provides tools for inventory tracking, receiving, picking, shipping, and warehouse operations management.
User Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the service
- Interfere with or disrupt the service or servers
- Upload malicious code or content
- Resell or redistribute the service without authorization
Data Ownership
You retain all rights to the data you input into WarePulse. We do not claim ownership of your inventory data, customer information, or operational records. You may export your data at any time.
Payment Terms
All payment processing is securely handled by Stripe, Inc., a PCI Level 1 certified payment processor. By providing your payment information, you authorize us to charge your payment method for subscription fees.
- Subscription fees are billed monthly or annually as selected
- Free trials are available for new accounts; you will not be charged until the trial period ends
- You may cancel your subscription at any time before the trial ends to avoid charges
- All fees are non-refundable except as required by law
- We reserve the right to modify pricing with 30 days notice
- Failure to pay may result in suspension of service
Your use of Stripe's services is subject to Stripe's Terms of Service.
Service Availability
We operate with an internal availability target of 99.5% (non-binding operational SLO). SLA guarantees, if applicable, are defined by contract for eligible plans.
Limitation of Liability
To the maximum extent permitted by law, Next Movement shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Termination
Either party may terminate this agreement at any time. Upon termination, you will retain access to export your data for 30 days. After this period, your data may be permanently deleted.
Governing Law
These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
